Reuters and Wall Street Journal report that Tiffany filed suit against eBay "alleging that the Internet auction site should be held accountable for the sale of counterfeit Tiffany jewelry through eBay." Tiffany said 73% of items purchased on eBay in a study it conducted were counterfeit.
In Germany, a court ruled in favor of eBay in a lawsuit filed in April 2001 by Montres Rolex S.A. According to eBay's annual report, Rolex may appeal the ruling to the German Federal Supreme Court. The suit had alleged eBay subsidiaries were infringing Rolex's trademarks and sought an order forbidding the sale of Rolex-branded watches on eBay and damages.
